Welcome to Cerenity (the "App"), an AI-powered personal wellness application provided by Cerenity Innovation, Inc. ("Cerenity," "we," "us," or "our").
These Terms of Use ("Terms") govern your access to and use of the App and its related services (collectively, the "Services").
By accessing or using the Services, you agree to these Terms and acknowledge our Privacy Policy.
Certain uses of personal information, including the use of eligible personal wellness information for training and improving shared Cerenity AI models, may require separate consent. Acceptance of these Terms alone does not replace any separate consent required by applicable law or platform requirements.
If you do not agree to these Terms, please do not use the Services.
Cerenity is an AI-powered personal wellness companion designed to help users better understand their daily energy levels, stress-related patterns, and overall well-being.
The Services may include:
Certain features may require access to compatible wearable devices, health and fitness platforms, calendar information, location information, or other information, subject to your permissions.
The availability and functionality of the Services may vary based on your device, operating system, location, connected services, and the permissions you provide.
Cerenity is intended for general wellness, self-awareness, and informational purposes.
Unless expressly stated otherwise and supported by applicable regulatory authorisation, Cerenity is not a medical device and is not intended to diagnose, treat, cure, prevent, or medically monitor any disease, disorder, or medical condition.
Cerenity does not provide medical diagnoses, psychological diagnoses, psychotherapy, or professional medical advice.
You should not rely on information provided by Cerenity as a substitute for advice from a qualified healthcare professional.
Please review the Cerenity Disclaimer for additional information.
Unless otherwise expressly stated for a particular version of the Services, Cerenity is intended for users aged 18 or older.
Where account registration is required, you agree to provide accurate and current information.
You are responsible for maintaining the confidentiality and security of your account credentials and for activity conducted through your account, except where such activity results from circumstances for which Cerenity is legally responsible.
Please notify us promptly if you believe your account has been accessed without authorisation.
Certain features require permission to access and process information that may include:
We will request relevant permissions through the App, your operating system, or a connected service where required.
You may manage or withdraw device-level permissions through the relevant device or service settings.
If you decline or withdraw particular permissions, some Services may become unavailable, less accurate, or less personalised.
Our handling of personal information is described in greater detail in our Privacy Policy.
Artificial intelligence is a core component of Cerenity.
Cerenity uses eligible information to perform two distinct but related forms of AI processing:
We process your information to provide personalised predictions, recommendations, wellness patterns, energy forecasts, and other Services specifically for you.
With the appropriate notice and consent, Cerenity also uses eligible personal wellness information to develop, train, fine-tune, test, validate, calibrate, evaluate, and improve AI models and analytical systems that may subsequently be used to provide Services to multiple Cerenity users.
This means that eligible information contributed by one user may help Cerenity improve the performance, reliability, safety, personalisation, and accuracy of shared Cerenity AI systems.
Shared model improvement may include identifying generalised relationships between physiological information, activities, schedules, environmental factors, reported wellness states, and AI-generated outputs.
Where required, Cerenity will obtain separate affirmative consent before using personal wellness information for shared AI model improvement.
Health and fitness information obtained through Apple HealthKit or other health-data platforms is subject to additional restrictions.
Cerenity will only use such information in accordance with applicable platform requirements, user permissions, and law.
HealthKit-derived information will not be used for:
Where HealthKit-derived information is used for Cerenity model improvement, such use will be limited to developing or improving health and wellness functionality associated with the Cerenity Services and will be subject to the permissions required by Apple and applicable law.
Cerenity will not authorise a third-party AI provider to use HealthKit-derived personal data for the third party's own unrelated or general-purpose AI model training.
Where separate consent is required or requested, Cerenity will explain the categories of information involved and the purpose of the processing before the information is used for shared AI model improvement.
You may withdraw a consent previously provided for future model-improvement processing using the privacy controls made available by Cerenity or by contacting us at info@cerenityinnovation.com.
Following withdrawal, Cerenity will stop adding newly collected eligible personal data to shared-model training based on that consent within a reasonable operational period.
Withdrawal does not necessarily reverse model training that was lawfully completed before withdrawal.
Where information has already contributed to a trained model, it may not always be technically possible to isolate or remove the effect of an individual data point from the model.
This does not limit any deletion, objection, withdrawal, or other rights that apply under applicable law.
Further information is provided in our Privacy Policy.
Cerenity uses computational and machine-learning models to generate forecasts, correlations, recommendations, and personalised insights.
You acknowledge that:
You remain responsible for deciding whether and how to act on information provided through the Services.
Cerenity does not guarantee the accuracy, reliability, completeness, or suitability of any prediction, recommendation, or AI-generated output for any particular purpose.
Nothing in these Terms limits rights or liabilities that cannot legally be excluded.
You agree not to:
We may restrict or suspend access where reasonably necessary to address violations, security threats, misuse, or legal obligations.
All rights, title, and interest in the App and Services, including Cerenity's software, models, algorithms, interfaces, designs, trademarks, and proprietary technology, belong to Cerenity or its licensors.
We grant you a limited, personal, non-exclusive, non-transferable, revocable right to use the Services in accordance with these Terms.
You retain any rights you have in information you provide to Cerenity.
Nothing in these Terms transfers ownership of your personal information to Cerenity.
Cerenity's rights to collect, analyse, use, retain, or otherwise process personal information, including for AI model improvement, are governed by these Terms, the Privacy Policy, applicable consent, platform requirements, and applicable law.
Cerenity may rely on third-party providers for infrastructure, data processing, authentication, analytics, connected-device integrations, AI processing, and other technical functions.
Where personal information is provided to a third-party AI or technology provider, Cerenity will disclose and obtain permission as required by applicable law and platform rules.
Unless separately disclosed and expressly authorised, third-party providers acting on behalf of Cerenity are not authorised to use Cerenity users' personal wellness information to independently train their own general-purpose AI models.
Third-party services may also be governed by their own terms and privacy policies.
We may modify, update, improve, suspend, or discontinue aspects of the Services for operational, technical, security, legal, or product-development reasons.
We will provide notice of material changes where required by applicable law.
We do not guarantee uninterrupted availability or compatibility with every device, wearable, operating system, or third-party service.
To the maximum extent permitted by applicable law, Cerenity will not be liable for indirect, incidental, special, consequential, or similar losses resulting from use of the Services where such liability may lawfully be limited.
Nothing in these Terms excludes or limits liability for fraud, wilful misconduct, gross negligence where such exclusion is prohibited, or any other liability that cannot lawfully be excluded or limited.
Mandatory consumer protection rights remain unaffected.
You may stop using Cerenity at any time.
Where account creation is supported, you may initiate deletion of your account using the account-deletion functionality provided by Cerenity.
Following a valid deletion request, Cerenity will delete or appropriately de-identify personal information associated with your account in accordance with our Privacy Policy and applicable law, except where retention is legally required or permitted.
Deleting your account will stop future use of newly collected personal information for shared AI model training.
Deletion may not automatically reverse lawful training already completed using information previously contributed to shared models. Cerenity will nevertheless honour applicable legal rights relating to personal information and AI model processing.
We may update these Terms to reflect changes in the Services, AI technology, data practices, applicable laws, or business operations.
We will provide appropriate notice of material changes.
Where legally required, additional consent will be obtained before materially different processing begins.
These Terms are governed by the laws of the State of California, United States, without regard to conflict-of-law principles, except where mandatory laws applicable to you provide otherwise.
Nothing in these Terms limits mandatory consumer or privacy rights that apply in your country or region of residence.
